Family of Killed Wal-Mart Worker Files Suit

GARDEN CITY, N.Y. (AP)  -- The family of a man trampled to death by customers storming into a Long Island Wal-Mart has filed wrongful death lawsuits against the store and the mall where it happened.

The family also filed notice that Nassau County and its police department will be sued.

The lawsuit was filed Wednesday in state Supreme Court in the Bronx on behalf of Elsie Damour Phillipe, the sister of victim Jdimytai Damour. Phillipe, who lives in the Bronx, is the court-appointed administrator of her brother's estate.

Damour, a temporary worker hired for the holiday season, was crushed to death when some 2,000 customers stormed into the Valley Stream store on ``Black Friday.''

None of the defendants in the lawsuit immediately responded to requests for comment.
